Terms of Service

These are the Terms of Service (also our Terms & Conditions) of Brian Lee (sole proprietor), operating as Fecit, who runs DearKith, a private family legacy-message vault. By creating an account or using the service you agree to them.

The service

DearKith lets a vault owner store messages — text, voice, photos — for named recipients, and delivers them under the owner's conditions: at the owner's direction, or through a release process that a trusted contact starts and a human reviews. DearKith is built for one job: keeping your messages safe and delivering them to the right people.

Your account

Keep your credentials safe and your account information accurate. You are responsible for activity under your account, and for having a personal or household relationship with the recipients and trusted contacts you add.

Your content

You own the content you store. You grant DearKith only the limited license needed to operate the service: to store your content, process it (including transcribing voice recordings), and deliver it to the people you designate. We claim no other rights to it.

Recipients

Recipients never pay to access material that has been delivered to them. This is a founding commitment of the service, not a promotional offer.

Acceptable use

Do not use DearKith to store or send unlawful content, to harass anyone, or to add people's contact details without a genuine personal connection to them. We may suspend accounts that violate these terms.

Availability and disclaimers

DearKith is provided "as is." We work hard on durability — it is the point of the product — but we cannot promise uninterrupted availability, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, to the extent the law allows.

Ending your use

You can export your vault and delete your account at any time from the app. Deletion follows the process described in our Privacy Policy.

Changes, law, and contact

If these terms change materially, we will announce it in the app before the change takes effect. These terms are governed by the laws of California. Questions: support@dearkith.com.
